These Terms of Use (“Terms”) are a legal agreement between you and MyCargoRacks.com (“MyCargoRacks,” “we,” “us,” or “our”). By accessing or using this website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract to use this site. By using MyCargoRacks, you represent that you meet these requirements.

2. License to use the site

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the content on MyCargoRacks for your personal, non-commercial use. You may not:

MyCargoRacks publishes independent reviews and buying guides for cargo racks, bike racks, kayak carriers, ski carriers, rooftop tents, and related automotive accessories. All content is provided for informational and educational purposes only.

Our fitment guidance, weight limits, installation walkthroughs, and safety notes are based on manufacturer specifications and our own testing at the time of writing. They are not a substitute for the official owner’s manual, manufacturer instructions, or professional installation. Before installing or using any rack, cargo carrier, or vehicle accessory, you must:

• Read and follow the manufacturer’s installation and use instructions
• Confirm compatibility with your specific vehicle make, model, year, and trim
• Verify weight capacities, tongue weights, and clearance requirements
• Comply with all local, state, and federal laws regarding cargo, trailers, lighting, and road use
• Obtain professional installation if you are not confident doing it yourself

7. No warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYCARGORACKS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MYCARGORACKS AND ITS OWNERS, OPERATORS, EMPLOYEES, CONTRIBUTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO:

• Any damage to your vehicle, property, cargo, or personal belongings resulting from the installation or use of any product featured on the site
• Any personal injury, wrongful death, or property damage resulting from rack failure, cargo loss, or improper installation
• Any fines, penalties, or legal action resulting from non-compliance with traffic, trailer, or cargo laws
• Errors, inaccuracies, or omissions in content
• Unauthorized access to or alteration of your data
• Any product or service obtained through a link on the site

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you in full. Nothing in these Terms excludes liability that cannot be excluded by law.

9. Assumption of risk

Outdoor activities — overlanding, mountain biking, kayaking, skiing, snowboarding, rooftop camping, and traveling with heavy cargo — carry inherent risks. By using MyCargoRacks content to make gear decisions, you acknowledge that you assume all risks associated with the activities, the products, and the installation or use of those products.

10. Indemnification

You agree to defend, indemnify, and hold harmless MyCargoRacks and its owners, operators, employees, contributors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys’ fees) arising from: (a) your use of and access to the site; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; or (d) any claim that your content caused damage to a third party.

11. Intellectual property

All content on MyCargoRacks — including text, graphics, logos, photographs, illustrations, video, audio, software, and code — is owned by MyCargoRacks or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. The “MyCargoRacks” name and logo are trademarks of MyCargoRacks.

Brand names, product names, and logos of third parties belong to their respective owners. Their appearance on this site does not imply endorsement of MyCargoRacks by those brands unless explicitly stated.

12. Copyright complaints (DMCA)

If you believe content on MyCargoRacks infringes your copyright, send a notice to dmca@mycargoracks.com containing the information required by 17 U.S.C. § 512(c)(3): a physical or electronic signature of the copyright owner or authorized agent; identification of the copyrighted work; identification of the allegedly infringing material with enough detail to locate it; your contact information; a statement that you have a good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.

13. Third-party links

MyCargoRacks contains links to third-party websites, including retailer and manufacturer sites. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party site. Your use of third-party sites is governed by their terms and policies, not ours.

14. Termination

We may suspend or terminate your access to the site, in whole or in part, at any time and for any reason, including violation of these Terms. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, intellectual property, and governing law) will survive.

15. Governing law and venue

These Terms and any dispute arising out of or related to them or the site are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. You agree that any legal action brought against MyCargoRacks must be commenced exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

16. Dispute resolution

Before filing a claim, you agree to first contact us at legal@mycargoracks.com and attempt in good faith to resolve the dispute informally. If we cannot resolve it within 60 days, either party may proceed with formal legal action, subject to the governing-law and venue provisions above.

17. Changes to these Terms

We may revise these Terms from time to time. The revised version will be effective when posted, and the “Last updated” date at the top will reflect the change. Your continued use of the site after changes are posted constitutes your acceptance of the revised Terms. Material changes will be announced more prominently.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and MyCargoRacks regarding the site and supersede any prior agreements.
